Like many things in 2020, the COVID pandemic delayed the federal Equal Employment Opportunity (EEO) reporting but with a new year it’s time to start thinking about it again. Back in May of 2020, the Equal Employment Opportunity Commission (EEOC) delayed the filing deadline for the 2019 and 2020 reports until March 2021. However, the EEOC has recently released new guidance that states that data collection for EEO-1’s will open up in April 2021. The data collection date for other EEO categories varies. For this article, we will mostly be discussing EEO-1’s, but if you fall into another category, there may be different filling requirements. For your reference, I included links to the EEOC website below the post so you can see which category your company fits into.
So, what should you be doing right now? For those of you who have done EEO-1 filing in the past, you’re aware that in 2019 the process got significantly more complex because the reporting started to include not just position, gender, and ethnicity, but also payroll data. Those requirements have not changed, so if you struggled to gather the appropriate information in 2019 or if your company is reporting now for the first time, you should review the requirements and start collecting that information so that you are prepared when filling opens up in April.
How do you know if you should start preparing for this? In general, the EEO-1 filing requirements apply to any private employer with over 100 employees or any federal contractor with over 50 employees and $50,000 in federal contracts. If you are a first-time filer, you can find a registration form online to fill out. When your registration is completed, the EEOC will issue a company number to the employer and filers will be able to log in the system.
